⚠️ DRAFT — NOT LEGAL ADVICE. A working template for a licensed attorney to review, adapt, and finalize before use. The arbitration/class-waiver, data license, knife-safety/assumption-of-risk, indemnification, and score-disclaimer sections are material and jurisdiction-sensitive (especially in California). Replace every [BRACKET]. This draft was hardened against a benchmark study of Uber, Instacart, DoorDash, and screening-marketplace (Thumbtack/TaskRabbit/Care.com) terms — see
legal/RESEARCH_SYNTHESIS.md.
These Terms of Service ("Terms") are a binding agreement between you and [COMPANY LEGAL NAME] ("CookCredit," "we," "us") governing your use of cookcredit.com, the CookCredit app, and the knife-skill capture tool (the "Services"). By creating an account, checking the consent box, or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
⚖️ PLEASE READ SECTION 15 (DISPUTES) — IT REQUIRES BINDING ARBITRATION AND WAIVES CLASS AND MASS ACTIONS, SECTION 9 (KNIFE SAFETY / ASSUMPTION OF RISK), AND SECTION 10 (INDEMNIFICATION).
"Minimum Age" means 18 years old, or such greater age as is required by the laws of your jurisdiction for us to lawfully collect biometric data and provide the Services without parental consent. You must be at least the Minimum Age and able to form a binding contract to use any part of the Services. The skill-capture feature involves handling a knife, recording video, and capturing hand-motion data and may award CookCredit credits for performance; because that is a compensated, skill-validating activity, the Minimum Age applies to it without exception.

CookCredit provides: (a) a camera-based knife-skill assessment that produces a provisional, informational score and feedback; and (b) a marketplace connecting home cooks with eaters/customers. We are a neutral venue and technology provider. We are not an employer, staffing agency, culinary school, or certifying body, and we do not guarantee any job, income, booking, or outcome.
You are responsible for your account credentials and all activity under your account. Provide accurate information and keep it current. Notify us promptly of any unauthorized use.

similar cook tier shown to eaters indicates only that a cook completed a specific assessment process at a point in time. It does not constitute an endorsement, warranty, certification, guarantee, or representation of a cook's current competence, food safety, or fitness, and it is not a substitute for your own judgment — you assume the risks of any booking. A short version of this disclaimer is surfaced with the badge in the product.
synthetic input). We use liveness and integrity checks and may void results we believe are fraudulent. Validation-grade anti-cheat is enforced server-side and may change.
"CookCredit" credits and any cents/points shown are promotional and symbolic, have no cash value, are not legal tender, securities, or stored value, are non-transferable, and may be modified, expired, or revoked at any time, including if we determine a session was fraudulent or a score was provisional. Any monetary payout, if offered, is governed by separate written payout terms and is awarded only after server-side validation.
If you book or offer services through the marketplace: cooks and eaters contract directly with each other; CookCredit is not a party to that contract and is not responsible for the food, services, safety, conduct, or outcomes. Cooks are responsible for their own licenses, permits, food-safety/cottage-food compliance, taxes, and insurance. Payments, fees, refunds, and cancellations (if any) are governed by the in-product checkout terms and our payment processor's terms. CookCredit does not employ cooks.
You agree not to: break the law or others' rights; upload content you lack rights to or that depicts others without consent; harass, defraud, or impersonate; reverse-engineer, scrape, or overload the Services; circumvent the assessment or security; or use the Services to build a competing dataset/model. We may suspend or remove content or accounts that violate these Terms.
You retain ownership of the recordings, motion data, and other content you submit ("User Content"). By submitting User Content and checking the consent box, you grant CookCredit a worldwide, non-exclusive, royalty-free, fully paid-up, sublicensable, transferable, and — except as limited below — irrevocable and perpetual license to host, store, process, reproduce, modify, create derivative works from, and otherwise use your User Content and all data derived from it to operate, develop, evaluate, and improve the Services and to train, validate, and improve machine-learning, AI, and robotics models, consistent with the Privacy Policy.

We may assume the exclusive defense of any matter subject to indemnification, in which case you will cooperate with us.
The Services, including software, models, designs, and trademarks (the "CookCredit" name and logo), are owned by CookCredit or its licensors and protected by law. We grant you a limited, revocable, non-transferable license to use the Services for their intended purpose. No other rights are granted.
The Services rely on third parties (e.g., cloud hosting, MediaPipe/ML runtimes, payment processors). Their terms and privacy practices govern their portions, and we are not responsible for them.
THE SERVICES, SCORES, AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that scores are accurate, that any cook tier reflects actual quality or competence, that the Services are error-free or secure, or that any result will be achieved. Some jurisdictions do not allow certain disclaimers, so parts may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CookCredit AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR PERSONAL INJURY ARISING FROM YOUR USE OF A KNIFE OR THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.
